The Library is permitted to make a single copy of a work and distribute it if: a) there is no commercial advantage in the transaction, b) the library collection is open to the public and c) the copy of the work contains a notice of copyright. Additionally the library is permitted to make a replacement copy of a work if a reasonable effort has been made to obtain a copy of the work from common trade sources, the owner or publisher or an authorized reproducing service. Part IV - Interlibrary Loan Interlibrary loan should not be used in such aggregate quantities as to substitute for the purchase of or subscription to a work. The National Commission on New Technological Uses of Copyrighted Works has developed guidelines for interlibrary copying of copyrighted materials, briefly summarized as follows: 1. Within a calendar year a library is limited to a total of five filled requests from other libraries for articles from a given periodical for the prior five year period. 2. All requests should bear a notice that the requestor is in compliance with the guidelines. 3. The requestor is responsible for maintaining records to demonstrate that the guidelines are being met. |
